Conventional waiting period exceptions
The 7-year conventional waiting period after foreclosure can be reduced to 3 years with documented extenuating circumstances and a minimum 10% down payment. The 4-year short sale waiting period can be reduced to 2 years with extenuating circumstances.
Extenuating circumstances are defined as events beyond the borrower's control — serious illness, job loss due to company closure, death of a wage earner. Financial mismanagement does not qualify as an extenuating circumstance.
VA foreclosure and entitlement
A VA foreclosure creates an additional complication: if the VA paid a claim on the foreclosed loan, that amount reduces your remaining VA entitlement. This can affect your ability to use VA financing again without a down payment.
